PURPOSE OF THE PROJECT The European Arrest Warrant Project of the ECBA aims to create a network of criminal defence lawyers with particular experience in European Arrest Warrant (EAW) surrender cases and to create a knowledge centre on defence rights of suspects in surrender cases.
RESEARCH METHOD In each EU Member State a criminal defence lawyer with experience in surrender cases was contacted to participate in this project. Each participant completed a questionnaire on basic elements of criminal procedural law in their own jurisdiction, including pre-trial detention, legal assistance, pre-trial investigation: interrogation and access to the file / information, investigation at trial, post-trial and specialised lawyers.
The participants also identified noteworthy case law on defence rights of suspects in surrender cases. Summaries of the case law is published on the website. The participants are invited to attend two expert meetings to discuss the practical implementation and actual use of the EAW. The progress of the project will also be presented during these meetings.
